Supplemental Environmental Projects
Pollution prevention supplemental environmental projects (P2 SEPs) are
environmentally beneficial projects that a defendant agrees to perform
in an enforcement settlement. Ohio EPA encourages the use of P2 SEPs
to achieve additional environmental benefit beyond that specifically required
by law. In exchange for performing a P2 SEP, Ohio EPA may consider
a reduction in enforcement penalties in the settlement.
Since 1991, Ohio EPA has incorporated P2 SEPs into over 91 enforcement
settlements.
P2 is the use of source reduction and as a second preference, environmentally-sound
recycling. P2 SEPs used by Ohio EPA typically include P2 Programs
(P2 assessments) and P2 Projects (including Third Party
Projects).
The Ohio EPA Office of Pollution Prevention (OPP) works with agency
enforcement staff and defendants to identify appropriate P2 SEPs for enforcement
settlements.
