Ohio EPA Land Application of Sewage Sludge Management Plan Application Instructions

A Sludge Management Plan (SMP) approved by the Director of Ohio EPA, or a valid Ohio NPDES permit, is required prior to sewage sludge land application in Ohio. Until Ohio has delegation of the federal sewage sludge program, and until such time as all NPDES permits include specific disposal, use, storage, or treatment requirements for sewage sludge, there is a need for SMPs. Ohio EPA has simplified the process for submission of a SMP application for the land application of sewage sludge. The application procedure is as follows.

An application cannot be considered complete unless all applicable questions are answered and the required information submitted. An application shall include a narrative description of the treatment works sewage sludge handling processes that are designed to meet the requirements for land application under Chapter 3745-40 of the Ohio Administrative Code. Issuance of the Permit-to-Install/Plan Approval shall constitute approval of those sewage sludge handling processes, in accordance with Ohio Revised Code, Sections 6111.44 and 6111.45.

2. The completed applications must be submitted to the Ohio EPA District Office having jurisdiction over the county(ies) where the land application is to take place. The fee and two copies of the application forms should be submitted to the District Office. The Ohio EPA offices and their jurisdictions are as follows.

3. Ohio Revised Code Chapter 3745 requires an application fee of $100. It also requires a plan review fee of $100. The fee of $200 must be submitted in the form of a check made payable to "Treasurer, State of Ohio". The application and plan review fees are non-refundable and due at the time of application.
4. The application must be signed in accordance with the Ohio Administrative Code or it can not be accepted. The official applicant signature must be placed on Page 3 of Form A in the last box. The code mandates that a sewage sludge Permit-to-Install/Plan Approval application shall be signed by either the president, vice president or highest ranking corporate officer with offices located in the state of Ohio, or the owner of the entity planning to apply the material. In the case of a publicly owned treatment facility, the application shall be signed by the highest ranking public official of the governing body from which the material is generated ( the city mayor in most cases). There is no provision for duly authorized representatives signing sewage sludge Permit-to-Install/Plan Approval applications. The B forms must be signed by the person who prepares the application.
5. For land application of non-exceptional quality sewage sludge permittees shall obtain from the Division of Surface Water a specific site authorization for the site to which the land application of sewage sludge is to occur. This requirement for specific site authorization does not apply to the land application of exceptional quality sewage sludge. Applications for specific site authorizations shall be on Site Authorization Forms [PDF 33K].
