The draft amended rules are available below. Notice has been sent out for interested party review. After considering comments and making changes, if necessary, to the rules, a public hearing and another public comment period will be scheduled in late summer 2011.
Background
Ohio Administrative Code (OAC) Chapters 3745-3 and 3745-36 provide the administrative requirements for the development and implementation of pretreatment programs, regulating industrial discharges to publicly owned treatment works. These rules are also known at the Pretreatment Rules and IDP (Indirect Discharge Permit) Rules.
The rules under OAC Chapters 3745-3 and 3745-36 have been reviewed pursuant to section 119.032 of the Ohio Revised Code. Ohio EPA is required to review its rules every five years to determine if the rules need revisited. At this time, amendments are being considered for seven rules and no changes have been identified for four rules in the two chapters.
