Ohio EPA Implements House Bill 397 Construction & Demolition Debris Program Changes
|

On December 22, 2005, Governor Taft signed into law House Bill 397 ("HB 397").
The bill makes several changes to Ohio Revised Code § 3714. (Ohio's construction and demolition debris management statute). In general, the bill implements new siting criteria and requires rules to be adopted governing ground water and leachate monitoring, closure and the post-closure care of facilities, pulverized debris, and rejected load reporting, among other requirements. The bill also requires the issuance of a permit-to-install for a new construction and demolition debris facility and instructs Ohio EPA to develop a permitting program in 180 days to implement this requirement. Revisions Underway to Ohio's Residual Solid Waste Rules
|
|
|
In the budget bill passed by the General Assembly (House Bill 66), certain wastes from the manufacture of shale and clay
products would no longer be considered solid waste. As a result, this material would have been largely unregulated despite the fact that some of these waste streams are capable of leaching harmful
pollutants.
Due to the potential impact on public health and the environment, Governor Taft vetoed this language. However, he directed Ohio EPA to develop rules that tailor regulatory
controls to better address the potential harms presented by disposal of these materials. The rules will allow less costly disposal options for this type of waste while protecting public health and the

Construction & Demolition Debris Legislation - HB 432
|
|
|
On January 14, 2005, Governor Taft signed new construction and demolition debris (C&DD) legislation, Amended Substitute HB 432, into law, which will become effective April 15, 2005. This new
legislation will primarily improve funding support to approved health district C&DD programs through a new fee of $0.60/ton or $0.30/cubic yard on the disposal of C&DD. In addition to the new
disposal fee, HB 432 removes the current C&DD facility license application fee, clarifies the definition of C&DD, authorizes the director of Ohio EPA to create an additional fee to support ground
water monitoring programs at C&DD facilities, and instructs Ohio EPA to draft Administrative Code rules, among other things see HB 432 Page
