House Bill 397 Construction & Demolition Debris Program Changes
Construction & Demolition Debris Interested Party Notification
On December 22, 2005, Governor Taft signed into law House Bill 397 ("HB 397"). The bill makes several changes to Ohio Revised Code § 3714. (Ohio's construction and demolition debris management statute). In general, the bill implements new siting criteria and
requires rules to be adopted governing ground water and leachate monitoring, closure and the post-closure care of facilities, pulverized debris, and rejected load reporting, among other requirements. The bill
also requires the issuance of a permit-to-install for a new construction and demolition debris facility and instructs Ohio EPA to develop a permitting program in 180 days to implement this requirement.
HB 397 contains provisions that take effect in three distinct time frames: Immediately on December 22, 2005, upon adoption of rules, and upon each facility license renewal. On January
12, 2005, Ohio EPA mailed to approved local health districts, C&DD facility owners and operators, and C&DD interested parties, a document explaining the basics of the HB 397 requirements. This document
is an important read for anyone involved in the regulation or operation of a C&DD facility in Ohio.
The DSIWM web page and Listserv will be used to keep interested parties up-to-date about the direction, program concepts, and plans regarding HB 432 and HB 397 implementation.
This will also provide opportunities for comment by interested parties. The HB 397 web page information and first Listserv announcement occurred on January 13, 2006. Ohio EPA encourages all interested parties to subscribe to the C&DD Listserv and to submit comments, suggestions, or questions for us to consider during this initiative as soon as possible after each new Listserv notification. Ohio EPA has developed the following concepts to implement rule changes in accordance with HB 397 and HB 432.
Given the statutory timeframe established in HB 397 to adopt rules to establish a new permit system, these concepts are being made available to the public to facilitate input and understanding. Ohio EPA encourages all interested parties to subscribe to the C&DD Listserv and to submit comments, suggestions, or questions for the agency to consider as soon as possible.
