Industrial Waste Beneficial Use

Recent Activities

  • Ohio EPA - Division of Materials Waste Management intends to move forward with the beneficial use rules in 2012 & 2013.
     
  • November 30, 2007 Due to the level of interest in these rules, the Director has decided to conduct a second interested party review (IPR) for these rules. The Division of Surface Water expects to have a responsiveness summary that addresses all the comments received from the initial IPR comment period (over 200 comments were received), as well as a revised set of draft rules, ready for public viewing and comment in fall of 2009. The second IPR comment period will provide interested parties with at least 30 days to comment.
     
  • December 8, 2006 The comment period on the draft rules governing the Beneficial Use of Industrial Waste has been extended until February 6, 2007.
     
  •  November 8, 2006 Draft rules governing the Beneficial Use of Industrial Waste are available for review and comment. The comment deadline is December 8, 2006.
     
  •  August 28, 2006 The Interested Party Comment Period for draft changes to rules that govern construction and demolition debris (C&DD) facilities and industrial waste facilities has been extended to November 1, 2006.
     
  •  July 21, 2006 In conjunction with the Division of Solid and Infectious Waste, a public meeting to discuss draft changes to rules that govern construction and demolition debris (C&DD) facilities and industrial waste facilities is scheduled for August 1, 2006.

Our Objectives

  • Develop common sense rules that protect public health and safety, and the environment;
  • Use sound science in the development of pollutant limits (see USEPA links below);
  • Develop rules that are easily read and understood;
  • Address materials in a comprehensive and consistent manner; and
  • Do not over-regulate benign materials.

Draft Rules Support Documents
    USEPA Industrial Waste Management Web Site
    USEPA developed an Industrial Waste Management web site that includes important information for any manager of industrial waste. The site includes a link to the Industrial Waste Evaluation Model (IWEM) developed by USEPA. When available, confined geotechnical fill, bonded surface course and road abrasive pollutant limits were obtained from IWEM Tier I values for land application.

    Ohio Drinking Water Standards (DWS, aka Maximum Contaminant Levels)
    were used for unconfined geotechnical fill for all pollutants that have an established DWS.

    Standards for Compost Products were used for all soil blend and land application pollutants that have an established compost quality standard.
     

 

USEPA Region 9 Preliminary Remediation Goals
Preliminary Remediation Goals (PRGs) are risk-based concentrations that are intended to assist risk assessors and others in initial screening-level evaluations of environmental measurements. Region 9 PRGs are used in draft rule 3745-525-806 in the following ways:
  • Region 9 PRG residential soil concentrations (mg/kg) were used for soil blend and land application pollutant limits when compost quality standards have not been established.
  • Region 9 PRG values for tap water (converted to mg/L) were used for confined geotechnical fill, bonded surface course, road abrasive, and unconfined geotechnical fill pollutant limits when IWEM or DWS values have not been established.
