This Division of Materials and Waste Management (DMWM) page provides information and access to current and pending rules on Ohio’s non-hazardous waste programs. This includes solid waste, infectious waste, and construction & demolition debris program rules.  There are also DMWM rules applicable to specific activities of solid waste management districts and local health departments.

The tabs below provide information and the status of specific DMWM rule development activities and opportunities for public input as well as the status of draft, proposed, and effective rules.  Links to general information which may be of use to individuals interested in rules or the rule-making process is found under the additional information tab.   These sites include the Register of Ohio, which contains all state agency rule proposal packages and the Joint Committee on Agency Rule Review, which is the legislative committee responsible for the review and processing of all state agency rules.

February 15, 2013 DMWM Final Files Infectious Waste Rules

DMWM has final filed the infectious waste rules and has made available an associated public notice. The effective date of this rule is February 4, 2013. This rule is also available at the Register of Ohio.

January 24, 2013 DMWM Final Files Solid Waste Financial Assurance Rule

DMWM has final filed rule 3745-27-17, Wording of financial assurance instruments and has made available an associated public notice .  The effective date of this rule is February 4, 2013. This rule is also available at the Register of Ohio.

January 7, 2013, DMWM Refiles Infectious Waste Rules

DMWM has refiled two infectious waste rules, OAC 3745-27-32 and 3745-27-36, originally filed on November 29, 2012.  3745-27-32 was amended to remove an unnecessary reference to spill/clean up kits and to include a missing appendix, and rule 3745-27-36 was refiled in order to make a change to the Rule Authorization Form.  To view the Rule Authorization Forms, please visit the Register of Ohio.

  • Solid/Non-hazardous Waste

    • Beneficial Use of Industrial Byproducts – 2012 Early Stakeholder Outreach

      DMWM and DSW have been exploring approaches toward promoting responsible beneficial use of industrial byproducts through development of a single beneficial use program.  A request for stakeholder input on developing a regulatory program for beneficial the use of industrial byproducts was described in the June 2012 Early Stakeholder Outreach - (ESO), and subsequent messages and meetings. This Beneficial Use Program would not change or replace existing beneficial use programs established in waste-specific rules such as hazardous waste, scrap tires, compost, sewage sludge and clean hard fill.  It is intended to replace the Integrated Alternative Waste Management Program (IAWMP) authorizations and update the Land Application Management Plan (LAMP) program used for the last several years.

      In consideration of comments received  in response to the June 2012 ESO, DMWM sought additional input by announcing via listserv message on November 16, 2012 that it would host three meetings in November and December, 2012.  These meetings included a presentation  to help clarify concepts and discuss comments received in response to the June 2012 ESO.

    • 2013 Stakeholder Beneficial Use Meetings

      Stakeholders suggested that DMWM continue an open and collaborative dialogue, so DMWM announced a plan to host periodic meetings through a December 19, 2012 listserv message.  The meetings would serve to gain stakeholder perspective, concerns, and suggestions regarding moving forward with the rule drafting effort.  Meetings have been held on January 16 and February 12, 2013.  The agendas for these meetings and any future meetings may be found on this website when they become available.  The next meeting is scheduled for Tuesday, February 12, 2013. DMWM intends to hold a third meeting in May to discuss progress on the rule writing effort.  Details of this meeting will be posted on this website and distributed through the listserv.  To ensure receipt of information via future listserv messages, interested persons are encouraged to sign up for DMWM’s beneficial use listserv.
