Ohio EPA, with the assistance of the Ohio Department of Development's Office of Energy Efficiency, has developed a guidance manual to assist those interested in applying for and obtaining NOx allowances from the Energy Efficiency/Renewable Energy and Innovative Technology set-asides.  These set-asides are provided in Ohio's NOx Budget Trading Program rules in Ohio Administrative Code ("OAC") Chapter 3745-14 and will be available for projects during the 2006 ozone season, May 1 through September 30.

June 9, 2008: Ohio EPA has refiled amended language for OAC rules 3745-15-01, 3745-15-02, 3745-15-04 through 3745-15-06, 3745-15-08, and 3745-15-09. These rules establish the general provisions for air pollution sources located in the State of Ohio. The rules were originally pulled from the rulemaking process to address comments received concerning the proposed rule changes.  Please review the synopsis, and responsive summary to comments, both linked immediately below, for details regarding changes made to the proposed rule language.  Please note, the refiled rules are not effective at this time. They will become effective at a future date after completion of a review by the Joint Committee on Agency Rule Review (JCARR). Please watch this website for future developments.

January 8, 2007: Ohio EPA is extending the public comment period on Ohio Administrative Code ("OAC") rules 3745-15-01, 3745-15-02, and 3745-15-04 to 3745-15-09. These rules establish the general provisions for air pollution sources located in the State of Ohio. The rules have been TBR'ed (pulled from the JCARR process for reconsideration and refiling at a later date). The comment period is extended by 30 days. Ohio EPA will be accepting comments through February 8, 2007. Please see the rule language, synopsis, responsive summary of comments, and public notice provided below, under the "November 30, 2006" header, for information on the rule changes and how to submit comments.

November 30, 2006: Ohio EPA is proposing revisions to Ohio Administrative Code ("OAC") rules 3745-15-01, 3745-15-02, and 3745-15-04 to 3745-15-09. These rules establish the general provisions for air pollution sources located in the State of Ohio. This rule review was performed primarily to satisfy the requirements of Section 119.032 of the Ohio Revised Code (five-year review). We found these rules to be necessary and with need for amendments. The rules are being proposed after a 30 day public comment period which closed on July 28, 2006. Several sets of comments were received. Please see the responsive summary below for Ohio EPA's responses. 

We are holding a public hearing at 2:00 PM on Monday, January 8, 2007 in Conference Room 5B, 5th Floor, Ohio EPA, Lazarus Government Center, 122 S. Front St., Columbus, Ohio and requesting comments by January 8, 2007 on the above changes. June 26, 2006: Ohio EPA has reviewed Ohio Administrative Code (OAC) Chapter 3745-15 to satisfy the requirements of Ohio Revised Code (R.C.) 119.032 (five-year review). These rules outline the general provisions for air pollution sources located in the State of Ohio. February 21, 2008: Ohio EPA has proposed amended and new rules in Ohio Administrative Code (OAC) chapter 3745-21, "Carbon Monoxide, Photochemically Reactive Materials, Hydrocarbons, and related Materials Standards " to the Joint Committee on Agency Rule Review (JCARR). Ohio EPA is proposing amended OAC rules 3745-21-01 to 3745-21-04, 3745-21-06, 3745-21-08 to 3745-21-16 and 3745-21-18. Ohio EPA is also proposing new OAC rules 3745-21-19 to 3745-21-23. These rules are related to the control of emissions of carbon monoxide, photochemically reactive materials, hydrocarbons, and related materials. The rules are being amended as a result of the requirements of Ohio Revised Code (ORC) 119.032 for 5 year review and as a part of Ohio's control strategy for volatile organic compounds (VOCs) in the Cleveland/Akron metropolitan area as required by our State implementation Plan. The package also contains an amendment to paragraph (U)(2)(f) of rule 3745-21-09 to address concerns raised by USEPA regarding the establishment and stakeholder review process of these types of alternative emissions limitations.

The rules are being proposed after a public comment period of 30 days which ended August 23, 2006, and a public comment period of 30 days for the change to 3745-21-09(U)(2)(f) which ended October 11, 2007.  Several comments were received during both comment periods. September 11, 2007: Ohio EPA has completed draft amendments for Ohio Administrative Code rule 3745-21-09. This paragraph is related to alternative emissions limitation(s) to the miscellaneous metal coating limits under OAC rule 3745-21-09(U)(1) which apply to a broad range of operations, including exceptional cases where these limits may not be reasonably achievable. Ohio EPA has the authority under ORC 3704.03(E) to establish alternative emission limitations. Our preliminary review indicates that this paragraph continues to be necessary and is in need of amendment. DAPC is proposing these changes to address concerns raised by USEPA regarding the establishment and stakeholder review process of these types of alternative emissions limitations.

July 21, 2006: Ohio EPA has completed a review of various rules in Ohio Administrative Code (OAC) Chapter 3745-21 to satisfy the requirements of R.C. 119.032 (five-year review). These rules are related to the control of emissions of carbon monoxide, photochemically reactive materials, hydrocarbons, and related materials. We find the rules to be necessary and with need of amendments. Ohio EPA is proposing to amend OAC rules 3745-21-01 to 3745-21-04, 3745-21-06, and 3745-21-08 to 3745-21-18. Ohio EPA is also proposing new OAC rules 3745-21-19 to 3745-21-23. Ohio EPA is proposing the amendments and new rules to meet the minimum requirements associated with adopting RACT requirements for the Cleveland/Akron moderate nonattainment area. These requirements were promulgated in U.S. EPA’s rule for implementation of the eight-hour ozone standard published in the November 29, 2005 Federal Register (70 FR 71612). March 6, 2008: Ohio EPA has completed draft language for amendments to Ohio Administrative Code (OAC) chapter 3745-77, "Title V Permit Rules." The amendments incorporate many fix-ups that DAPC believes will improve implementation of the chapter (such as supporting transition out of Title V) and updates the chapter to reflect certain federal updates to 40 CFR Part 70 that have been made since the previous review of the rules in OAC chapter 3745-77. In addition, general changes have been made to update and clarify the rules’ authorizing and amplifying statutes and update information on items incorporated by reference as required in ORC 121.72.

July 9, 2008: Ohio EPA has proposed amended rules in Ohio Administrative Code (OAC) chapter 3745-14, "Nitrogen Oxides - Budget Trading Program" to the Joint Committee on Agency Rule Review (JCARR). Ohio EPA is proposing amended OAC rules 3745-100-01, 3745-100-02, 3745-100-07, 3745-100-09, 3745-100-11, 3745-100-14, and 3745-100-15, proposing to rescind and replace with new text OAC rule 3745-100-05, and proposing new OAC rule 3745-100-17. These rules are being amended and/or promulgated as new as a result of two new rules finalized by the USEPA during reporting year 2006, for reporting year 2006. First, USEPA Toxic Release Inventory (TRI) finalized the “TRI NAICS Rule”, which requires TRI facilities to report North American Industry Classification System (NAICS) codes on their submissions instead of Standard Industrial Classification (SIC) Codes. Additionally, TRI also finalized the TRI Burden Reduction Rule which expands the eligibility for use of the Form A Certification Statement in lieu of the more detailed Form R.

The rules are being proposed after a public comment period of 30 days which ended December 10, 2007. No comments were received on the draft rule language. We are holding a public hearing on the new and amended rules at 10:00 AM on Monday, August 18, 2008 in Conference Room D, 6th Floor, Ohio EPA, Lazarus Government Center, 50 W. Town St., Suite 700, Columbus, Ohio and requesting comments by August 18, 2008 on the new and amended rule language. November 8, 2007: Ohio EPA has completed new draft language and draft amendments for rules in Ohio Administrative Code (OAC) chapter 3745-100, "Toxic chemical release reporting (TRI)". June 6, 2008: Ohio EPA has completed draft amendments for Ohio Administrative Code (OAC) rules 3745-109-01, 3745-109-04, 3745-109-07, 3745-109-08, 3745-109-11 through 3745-109-14, and 3745-109-17 through 3745-109-21. These rules are related to the Clean Air Interstate program which is Ohio’s implementation of the federal Clean Air Interstate Rules (CAIR) as first published in Volume 70 of the Federal Register, Page 25162 (70 FR 25162). These changes are necessary as a result of comments submitted by US EPA after the end of Ohio’s CAIR final rulemaking process. In addition, revisions were made to US EPA’s final CAIR rule on October 19, 2007 (72 FR 59190) that will also be incorporated into Ohio’s CAIR rules during this rulemaking.
