Section 3745.11(D) of the Ohio Revised Code

(3)(a) As used in division (D) of this section, "synthetic minor facility" means a facility for which one or more Permits-to-Install or Permits-to-Install and Operate have been issued for the air contaminant sources at the facility that include terms and conditions that lower the facility's potential to emit air contaminants below the major source thresholds established in rules adopted under section 3704.036 of the Revised Code.

(b) Beginning Jan. 1, 2000, through June 30, 2012, each person who owns or operates a synthetic minor facility shall pay an annual fee based on the sum of the actual annual emissions from the facility of particulate matter, sulfur dioxide, nitrogen dioxide, organic compounds and lead in accordance with the following schedule:

(4) The fees assessed under division (D)(1) of this section shall be collected annually no sooner than the 15th day of April, commencing in 1995. The fees assessed under division (D)(2) of this section shall be collected annually no sooner than the 15th day of April, commencing in 2005. The fees assessed under division (D)(3) of this section shall be collected no sooner than the 15th day of April, commencing in 2000. The fees assessed under division (D) of this section in a calendar year shall be based upon the sum of the actual emissions of those regulated pollutants during the preceding calendar year. For the purpose of division (D) of this section, emissions of air contaminants may be calculated using engineering calculations, emission factors, material balance calculations or performance testing procedures, as authorized by the director. The director, by rule, may require persons who are required to pay the fees assessed under division (D) of this section to pay those fees biennially rather than annually.
