What's New in Risk Management Plan (RMP) Reporting for 2009?

RMP*eSubmit is available

RMP*eSubmit provides the capability to submit your RMPs online via U.S. EPA's secure website which manages thousands of data submissions from states and industry.

Although facilities will have the option of using RMP*Submit2004, there will be no assistance in obtaining the software from the RMP Reporting Center after RMP*eSubmit is available. Submissions using RMP*Submit2004 will not be accepted after January 2010.

If the RMP is incomplete, the owner/operator will be required to use RMP*eSubmit to complete the plan.

It is important to update your process hazard analysis (PHA) and RMP audit dates in the Prevention Program section of the RMP.  RMP*eSubmit will provide a warning message for PHAs not updated in five years and audits not conducted every three years. 

The latest RMP that your facility submitted will be available on RMP*eSubmit.

Facilities claiming CBI will be required to use RMP*Submit2004 until September 2009.

Facilities will be required to complete an Electronic Signature Agreement (ESA). Although the CDX account is created immediately, it will take approximately three days to activate the account.

Paper copies of the RMP will be accepted for facilities with no Internet access or computer capabilities. 

Facilities have the option of submitting their RMP early to restart the anniversary date.  You need to mark the submission as a "Resubmission" in the drop down box to restart the five year clock.

Five-Year Updates

How to determine your 5-year anniversary date

U.S. EPA's interpretation of the regulations is that RMPs initially due on June 21, 1999 must be updated by June 21, 2004, not before.

If you have submitted your initial RMP after June 21, 1999, or have resubmitted since your initial submission, the 5-year anniversary date is calculated as 5 years from the postmark date of your latest submission.

U.S. EPA has developed "A Checklist for Resubmitting Your Risk Management Plan (RMP) for Chemical Accidental Prevention."

You may receive RMP program updates from U.S. EPA by e-mail through their listserv.  To subscribe, send an e-mail to: lyris@lists.epa.gov. Include the words: "subscribe EPA-CEPP your_name" in the body of the message. Replace "your_name" with your first and last names.

Accidental Release Prevention Requirements: Risk Management Program Requirements Under Clean Air Act Section 112(r)(7); Amendments to the Submission Schedule and Data Requirements; Proposed Rule

  • Facilities who have an accident that meets the criteria for the five-year accident history are required to update and re-submit their RMP within six months of the date of the accident
  • Facilities are required to correct their emergency contact information within one month of a change in the information
  • The requirement for facilities to briefly describe their off-site consequence analysis in the Executive Summary has been removed
  • Additional new data elements:
    -  Emergency contacts e-mail address-
    -  Reason for subsequent RMP submissions
    -  Contractor information
  • Revisions to RMP Submit format: revision of the RMP reporting of the five-year accident history to allow the owner or operator to indicate whether the accident involved an uncontrolled/runaway reaction
