Statement Concerning the Decision by Ohio EPA Director Scott Nally to Withdraw the Agency Water Quality Standards and 401 Water Quality Certification Rule Package

“After taking into consideration all of the information available to me, I have made a decision to withdraw Ohio EPA’s water quality rule package from JCARR and further vet them through the Common Sense Initiative process. I am confident the water quality rules are sound and clarify the requirements currently in place today, however, I believe the most prudent course to take is to utilize the new CSI process to address any potential concerns with the package.”

  • The water quality rule package was first introduced in February 2006.
  • The current package reflects changes made to address concerns with past versions.
  • The rule package includes state water quality standards, 401 water quality certifications and antidegradation.
  • Controversial sections of the package have been removed.
  • The package clarifies requirements currently in place.
